Mark Hardiman

Partner

Mark S. Hardiman is a partner at Nelson Hardiman and has more than a decade of experience representing and advising health care providers with respect to criminal investigations and charges, civil False Claims Act (FCA) and fraud lawsuits, administrative overpayment and disciplinary proceedings, and a wide range of regulatory compliance issues, including internal investigations and voluntary disclosures of possible violations of the FCA, federal anti-kickback statute and the Stark Law. Mark’s trial experience includes 22 jury trials and he has also argued six appeals before the Ninth Circuit Court of Appeals.

Rob Fuller

Partner

Rob Fuller is an experienced attorney with a record of hands-on leadership in the healthcare industry. He served as chief operating officer of a hospital for over a decade, and is a Fellow of the American College of Healthcare Executives. Rob’s expertise extends to trial and appellate work, transactional experience in mergers, acquisitions, financings and reorganizations, criminal defense, and regulatory work. He advises clients on antitrust, general corporate governance, nonprofit regulation, general commercial and real estate law. Rob also has significant lobbying and governmental representation experience.

Aaron C. Lachant

Aaron Lachant has a wide-range of experience representing providers in all aspects of healthcare law with a focus on administrative hearings and regulatory and litigation matters involving compliance, fraud and abuse, internal and False Claim Act investigations and both compliance and recovery matters with government-sponsored healthcare programs such as Medicare/Medi-Cal recovery audits. Aaron has also represented providers in litigation involving both U.S. and California constitutional issues and has worked with local governments in developing regulatory programs for certain healthcare industry sectors.

John A. Mills is a partner at Nelson Hardiman and has years of experience representing and advising health care providers in a wide range of regulatory compliance issues and litigation proceedings. John’s practice focuses on managed care and ERISA compliance and litigation, medical staff and peer review, civil False Claims Act and fraud lawsuits, commercial litigation, healthcare fraud investigations, and a wide range of regulatory compliance issues, including corporate internal investigations and voluntary disclosures of possible Medicare overpayments, analysis of business arrangements to ensure compliance with the anti-kickback and Stark laws, and providing transactional and regulatory guidance to covered entities and contract pharmacies in connection with the federal 340B program. John has jury trial experience and has handled numerous arbitrations and administrative hearings.

Zachary Rothenberg

Zach Rothenberg is a partner at Nelson Hardiman with nearly 15 years of experience litigating business disputes in federal and state courts and in arbitration. Zach’s practice focuses primarily on litigating healthcare industry business disputes. Zach regularly represents healthcare clients in cases involving breach of contract, fraud, unfair competition, and misuse of trade secrets, among others. Zach also has deep experience litigating employment-related cases, on behalf of both employers and employees, and litigating payment disputes involving managed care entities.

Sara brings unrivaled experience protecting the licenses of health care professionals. She has successfully defended hundreds of doctors, nurses, dentists, psychologists and other mental health professionals, pharmacists, physical therapists, and other healthcare professionals in license related matters, including, investigations and administrative hearings before licensing boards. She also advises professionals on professional liability and risk management issues, including compliance with state and federal regulatory requirements.

Mark Pollitt concentrates his practice on complex litigation in state and federal court on behalf of health care providers. He has broad experience representing health care providers in civil, criminal and administrative litigation, including disputes involving the Medicare program, health plan reimbursement, and alleged fraud and abuse. He is also experienced in advising clients on regulatory issues including compliance with the Stark law, the federal Anti-Kickback Statute and the corporate practice of medicine.

She also has extensive experience with general business contract negotiations, complex corporate reorganizations, and debt management. The matters she has handled involved not only the healthcare industry, but the finance, shipping, restaurant, and agricultural industries, as well. She has experience with cross-border transactions and insolvencies, and has had a multijurisdictional practice.

Mr. Zimmitti also brings extensive experience in litigating multi-million dollar provider reimbursement disputes, including those involving contracted/non-contracted payors, Medicare, ERISA, private insurance and managed care plans.
